In cases of onward transfers of data, received pursuant to the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, Global Lingo is potentially liable.
We may transfer personal information to third parties acting as controllers or agents only under strict conditions. For controllers, we require compliance with the Notice and Choice Principles and a contract ensuring data is processed for limited purposes consistent with your consent, with equivalent protection levels, and with provisions for notification and remediation in case of non-compliance. For agents, we limit data transfers to specified purposes, verify equivalent privacy protection, implement measures to ensure data is processed consistently with our obligations, require agent notification in case of non-compliance, take steps to stop unauthorized processing, and provide contract summaries to the Department upon request.

Global Lingo has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) and the UK Commissioners office (ICO) with regard to unresolved Privacy complaints concerning human resources data transferred from the UK and EU in the context of the employment relationship.
Under the Federal Trade Commission (FTC) Act, Global Lingos failure to abide by commitments to implement the Privacy Principles may be challenged as deceptive by the FTC. Global Lingo is subject to the investigatory and enforcement powers of the FTC. The FTC has the power to prohibit such misrepresentations through administrative orders or by seeking court orders; violations of those administrative orders can lead to civil penalties of up to $40,000 per violation or $40,000 per day for continuing violations
The Privacy framework provides the option for an EU and UK individual, as appropriate, to invoke binding arbitration to determine whether Global Lingo has violated its obligations under the Principles as to that individual and whether any such violation remains fully or partially unremedied.
Access to Your Information
The European legislative and regulatory body grants any data subject affected by the processing of personal data the right to request at any time information about and a copy of the scope of personal data stored about his or her person free of charge from the controller. The European legislative and regulatory body furthermore grants the data subject the right to request the following information:
